European Truck Cartel : Irish Claims

Five truck manufacturers, MAN, Volvo/Renault, Daimler, Iveco and DAF, have admitted to the European Commission that they participated in a price fixing cartel against purchasers of their trucks from 1997 until 2011. There has also been a finding against a sixth manufacturer, Scania, by the European Commission. As a result of the cartel, the price of trucks was artificially inflated in this period. Some estimate that each brand new truck which was sold in the period was overpriced by up to €10,000.

If you purchased, leased or outsourced trucks weighing 6 tonnes or more anywhere in Europe, between 1997 and 2011 (the cartel period), you may have a claim. Working together with Edwin Coe Solicitors in the UK, Claim Finance can assist you to pursue your claim without cost or risk.

The European Commission fined the companies as follows:

  • Daimler/Mercedes – €1 billion
  • Scania – €880 million
  • DAF – €752 million
  • Volvo/Renault – €670 million
  • Iveco – €495 million
  • MAN – fine of €1.2 billion reduced to zero as immunity applicant

The Claim

As a result of the cartel, any companies or individuals which leased purchased or outsourced trucks weighing six tonnes or more during that 14-year period, and shortly thereafter, will have a “follow-on” claim for damages because they will have overpaid for their vehicles.

Edwin Coe is acting on behalf of clients from across the EEA in these claims, including Ireland. Companies who purchased trucks in Ireland and other EEA jurisdictions are entitled to bring claims in the UK under European legislation as part of a group action. The Irish courts do not allow group actions, so to take advantage of the funding which we have available, Irish claims can be brought in London. Edwin Coe already represents many companies from across the EEA whose claims will be issued in one set of proceedings, in one venue.
